Our experience ranges from retail service station operations, to complex multiparty sites such as the Portland Harbor Superfund Site and the Lower Duwamish Superfund Site. We’ve successfully defended clients in enforcement actions and regularly assisted clients in navigating the maze of regulatory authorities to resolve liability under state and federal cleanup laws.
We navigate complex land-use regulations to obtain necessary approvals for our clients’ projects. Our clients include private and public developers, landowners involved in renewable and traditional energy projects, infrastructure construction, timberlands management, commercial development, manufacturing, and industrial facilities.
We have significant trial experience in natural resource, environmental, and land-use issues, including defense of the forest products industry from lawsuits threatening its economic vitality, to representing property owners in disputes over whether they can use their land. We have successfully defended clients in citizen suits and appealed permitting decisions that were contrary to the law or a client’s business needs. When regulatory attention results in enforcement actions, we help our clients evaluate options for litigation, appeal, or settlement. We believe that effective advocacy depends on our active participation in policy work. We often assist clients with rulemaking advocacy and administrative and judicial appeals of final rules.
When a business wants to construct, expand, or modify its operations, it often faces a daunting multi-jurisdictional permitting review process. We have extensive experience guiding businesses through complex permitting statutes, regulations and agency processes that apply to their projects. We manage issues that arise during the permitting process, such as land use compatibility, air and water impacts, climate change, species protection, and cultural and historical resources. When litigation threatens the permits on which a project depends, we work quickly and strategically to minimize delay and secure permits with reasonable conditions so that the project can proceed.
We have assisted in incident response and enforcement actions and with developing environmental compliance strategies. Our representation has included the most serious incidents, including those that have resulted in fatalities and significant property damages.
